to the following Terms and Conditions of Use. By using and purchasing
from this site, you agree to abide by these terms as set out below:

By entering, using and purchasing from this website you are deemed
to have read and accepted these Terms of Use. If you do not accept
these Terms of Use or any part of them, you should not purchase
from this website. Archer’s Arcadia may modify these Terms
of Use from time to time. Your continued use of this website following
such change demonstrates your agreement to be bound by the modified
Terms of Use.
2. Accuracy of Content
Archer’s Arcadia makes every effort to ensure that the content
of this website is accurate and up-to-date, however Archer’s
Arcadia does not offer any warranties (whether express implied
or otherwise) as to the reliability, accuracy or completeness
of the information appearing on this site, and/or availability
of items listed. We may remove material from this website at our
own discretion and without notice.
3. Correction of Errors and Inaccuracies, Limitations on Quantity
Whilst Archer’s Arcadia makes every reasonable effort to
present accurate information on this web site, the information
may contain typographical errors or inaccuracies and may not be
complete or current. We therefore reserve the right to correct
any errors, inaccuracies or omissions and to change or update
information at any time without prior notice (including after
you have submitted your order). Please note that such errors,
inaccuracies or omissions may relate to product description, pricing
and availability. We also reserve the right to limit quantities
(including after you have submitted your order). We apologise
for any inconvenience this may cause you. If you are not fully
satisfied with your purchase please see our returns policy for
details on how to obtain a refund.
4. Colours & Photographic Representation
We have done our best to display as accurately as possible the
colours and photographic representation of items shown on this
website, and to ensure they are a close and true representation
of the item offered for sale. However, because the colours and
images you see will depend on your monitor, we cannot guarantee
that your monitor's display of any colour will be accurate. Additional
photos and item information may be sent to you on request to further
illustrate and describe an item for sale.
5. Limitation of Liability
By using this website you agree that items listed on the “sales”
pages are offered on an "as is" and "as available"
basis. Archer’s Arcadia takes all reasonable steps to ensure
that the website is properly functioning at all times, that the
items listed are a true and close representation of the actual
artworks, and that all items listed are available unless otherwise
stated. By accepting these Terms of Use, you accept that Archer’s
Arcadia cannot be liable to you for any loss or damage you suffer
as a result of visiting this website, making use of the information
available on the website, or any loss or damage as a result of
having purchased items from this website. In no event shall Archer’s
Arcadia be liable for any indirect, special, incidental or consequential
damages including but not limited to loss of use, loss of data,
loss of profits or personal injury resulting from items purchased
from this site.
6. Privacy Notice
Personal information submitted via this site will remain private
and confidential and will not be passed to any third party. When
you make a purchase from our website, we collect certain personal
information from you (e.g. your name, email address, delivery
address and other details). All such information is held securely
and Archer’s Arcadia guarantees to treat all of your personal
information as strictly confidential.
In order to process your credit card transactions, we use PayPal.
PayPal receives the information necessary to verify and authorise
your preferred payment card and to process your order. PayPal
are under strict obligation to keep your personal information
private.
7. Postage and Handling Fees
Unless otherwise stated, all items listed on Archer’s Arcadia
are subject to packaging, postage, insurance and handling fees.
Other fees may also include customs, duties and import taxes;
all of these costs are the responsibility of the customer.
8. Returns Policy - 14 Days Satisfaction Guaranteed
If for any reason you are not 100% satisfied with your purchase,
you may return the item for a refund less the cost of return shipping
/ handling and insurance. Items must be returned in the original
packaging and in good order and condition.
If you wish to return an item purchased through this website,
you must first contact Archer’s Arcadia on david.archer1@bigpond.com
you will then be emailed delivery instructions on how to return
the product. Refunds on return goods will be issued within 30
days of receiving the returned item.
9. Damage in Transit
You are responsible for checking Products upon delivery and verifying
that they are in satisfactory condition, in accordance with their
description and complete. You may at your cost return purchased
Products in accordance with these Conditions. If a product has
been damaged in transit, please contact us immediately. Once we
receive the item(s), we will issue a refund or replacement(s),
whichever is requested and depending upon availability. Refunds.
Refunds will be issued within 30 days of receipt of the returned
goods. A refund will be issued for postage paid only when the
item is found to be defective or incorrectly supplied from the
original order. If you fail to return goods at your expense, we
reserve the right to charge the direct costs for their recovery
and may offset that amount against any refund due.
When returning an item, the parcel is your responsibility until
it reaches us. We recommend that you ask your postal service for
a proof of posting (usually available free of charge).
10. Deliveries and Risk
Delivery timescales/dates will vary depending on the destination
of the purchase.
Delivery shall be to a valid address only, submitted by you and
subject to our acceptance. It is your responsibility to arrange
for the collection and acceptance of any products delivered to
the delivery address. You must provide contact details so you
can be reached by customs if required. If you are unable for whatsoever
reason to take delivery or make contact with delivering parties
you must provide an alternative contact that can take delivery
for you.
If you are unable to arrange for receipt of delivery you shall
be liable to pay all costs of Product storage and any additional
costs incurred, including return packaging, postage and insurance
costs. We shall be entitled 30 days after the agreed date for
delivery to dispose of Products in such manner as we determine
and may set off any proceeds of sale against any sums due from
you.
Delivery to some countries may result in import duties, taxes
or fees. You will be liable for these costs. Save as otherwise
provided in these Conditions, risk of loss of or damage to the
Products passes to you on delivery or when placed in your possession
or that of any carrier or transport provided by you, whichever
shall occur first.
11. Terms of Payment
Accepted methods of payment will be PAYPAL. For purchases within
Australia please contact me regarding other possible methods of
accepted payment. Products will only be dispatched once full payment
has been received and cleared.
12. Termination
If you fail to pay any amount by the due date or breach any of
these Conditions then, without prejudice to any of our other
rights, we may stop any Products in transit; and/or suspend
further Product deliveries.
